1. Acceptance of Terms

By downloading, installing, or using SmokeAway (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

SmokeAway is a smoking cessation support tool that helps users track cravings, choose deflection strategies, and monitor progress through AI-powered insights. The App is not a medical device and does not provide medical advice.

3. Medical Disclaimer

SmokeAway is intended as a self-help tool only. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical concerns related to smoking cessation. If you experience a medical emergency, call emergency services immediately.

4. User Accounts

  • You must be at least 18 years old to use the App.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate information when creating an account.
  • You may sign in using email/password, Google Sign-In, or Apple Sign-In.

5. Subscriptions and Payments

  • Free Tier: Basic craving tracking and deflection features are available for free.
  • SmokeAway Pro: Premium features including weekly AI pattern analysis, craving forecasts, and full history access require a subscription.
  • Subscriptions are billed through Apple’s App Store. Pricing is displayed before purchase.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel subscriptions through your Apple ID account settings.

6. User Content

You retain ownership of any content you create within the App (custom deflection strategies, notes). By using the App, you grant us a limited license to process this content for the purpose of providing the service.

7. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App’s servers or networks
  • Create multiple accounts for fraudulent purposes

8. Intellectual Property

All content, features, and functionality of SmokeAway are owned by Tzrif86 and are protected by copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, SmokeAway and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. The App is provided “as is” without warranties of any kind.

10. Termination

We reserve the right to terminate or suspend your account at any time for violation of these terms. You may delete your account at any time through the App’s settings.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by the laws of Israel, without regard to conflict of law provisions.
